PETITION: Oppose Proposed Change of Use at 5 Windfall Court (Ref: 2026/02518/PA)

We, the undersigned residents of Pype Hayes and the wider Erdington community, call upon Birmingham City Council's Local Planning Authority to reject Application Number 2026/02518/PA. This application seeks a change of use from Class C3 (dwelling house) to Class C2 (residential institution) to provide supported accommodation for young people aged 16–17.

Our objections are based on the following urgent grounds:

  1. Allegations of Prior Unauthorised Use: Residents living adjacent to 5 Windfall Court have made consistent, detailed allegations that the property has been operated as an illegal HMO for two years prior to this current application. The community is deeply concerned that this change of use application is an attempt to regularise an established pattern of unauthorised and unmanaged use.

  2. Inappropriate Location: The property is situated less than half a mile from Paget Primary School. We believe this location is wholly inappropriate for this form of intensive supported accommodation, given its proximity to an establishment attended by young children.

  3. Community Impact & Cohesion: Residents are deeply concerned that the concentration of this use in an established, family-oriented residential street risks undermining the cohesion and stability of a community where families have lived for generations.

  4. Pressure on Public Services: Local policing and support resources are already under extreme strain. Residents believe that intensifying the use of this site will place further unsustainable demand on those limited services and infrastructure.

  5. Risk of Antisocial Behaviour: Neighbours have raised legitimate, evidence-based concerns regarding the potential for increased antisocial behaviour. These are not generalisations; they are based on lived experience of the property’s usage over the past two years.

Our Call to Action:

We call on Birmingham City Council to reject Application 2026/02518/PA in full. We demand that the Planning Authority investigates the allegations of prior illegal operation and gives full, proper weight to the depth and volume of local opposition.

WARD MEETING NOTICE: This petition and the situation at 5 Windfall Court will be on the agenda for our upcoming Ward Meeting on Tuesday 29th September 2026 at the HollyFields Sports and Conference Centre. I encourage all residents to attend and make their voices heard.
